The First Trial Judgment of the Liaoyang Ferroalloy Case

The spokesperson of the Liaoyang Intermediate People's Court notified journalists of the first trial judgment on the case of the Liaoyang Ferroalloy Factory Corporation's[LFFC] previous leaders yesterday [Mar 12, 2003]. It included the adjudication of the LFFC's ex-director and general manager Fan Yicheng.

According to the spokesperson of Liaoyang Intermediate People's Court, LFFC's former director and general manager Fan Yicheng was very irresponsible at work. His conduct caused state-owned properties to be defrauded and thus, a great deal of state-owned property was lost. As the director of the company, he allowed the import of unprocessed ores without the authorization of the custom department. He took part in illegally processing raw ores in China and selling them in order to make a profit. This conduct was considered as a dereliction of his duties as contracted and caused loss of state-owned property. The second offense was that of smuggling in ordinary goods. He was found guilty of both offences and sentenced to a 13 year term of imprisonment.

The previous manager of the LFFC's import and export department, Liu Yongjia, was charged with embezzlement of public funds, and was sentenced to a 6 year term of imprisonment. The former salesman of the Dalian Kaida Industrial Co. Ltd., Liu Zhe (the defendant Liu Yongjiafs son) was accused of corruption and embezzlement of public funds. He was condemned to a 17 year term of imprisonment and the confiscation of 270,000 Yuan.The previous manager of the LFFC's resources department, Cao Ce was found guilty of embezzling public funds and was sentenced to a 6 year term of imprisonment. The former LFFC director and assistant general manager, Wang Youguang, who was also the manager of the Liaoyang Iron Ore & Ferroalloy Distribution Conpany, was charged with negligence at work and illegal operation of the same type of business. He was condemned to a 4 year term of imprisonment and a fine of 20,000 yuan.

The spokesperson stated that the court would continue its mission in judging and carrying out strict judgments against commercial crimes, in order to protect state-owned properties from infringement. The promotion of the anti-corruption [campaign] and its role in enhancing social security and economic development were noted in his speech.
